Australian court has sentenced to Giedo van der Garde has a valid contract with Sauber which allows him to take the Swede’s place instead.

Prior to last season left Giedo van der Garde Caterham to become a test driver with Sauber. The Dutchman had a contract that said he would be driving for Sauber in 2015, but after a scoreless season he was fired and the team’s two other drivers. They were replaced by Marcus Ericsson and Felipe Nasr, as well as test driver Raffaele Marciello.
Giedo van der Garde believes that he has been fired in error and sued instead of getting back his place.
Last night announced an Australian court that the van der Garde has a valid contract with Sauber and that he is entitled to drive for them in the season opener in Melbourne on Sunday – and the rest of the F1 season.
Marcus Ericsson thus risk losing their place as van der Garde can take his or Nasrs place.
Marcus Ericsson advisor, Eje Elgh, was earlier this week not worried about the stormy situation.
– As far as I know, we have a water rights agreement, signed by all the rules. It feels safe and good for Marcus part, but I’m not a lawyer, he told Sport blade.
Sauber team boss, Monisha Kaltembon, believes it is too great a security risk to change drivers.
– We can not risk the safety of our team or any of the other drivers to have an unprepared driver in a car that has been tailored, he said.
